General terms and conditions

Article 1: General provisions

The e-commerce website of J&N Prints, represented by Jan Messagie, a company with registered office at Burrelstraat 5, 9100 Sint-Niklaas, Belgium, BE0866260973, (hereinafter 'J&N Prints') offers its customers the opportunity to purchase products from their webshop online.

These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the J&N Prints webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by J&N Prints.

Article 2: Price

All prices stated are expressed in EURO, always including VAT and all other taxes or duties that the Customer is obliged to pay.

If delivery, reservation or administrative costs are charged, this will be stated separately. All items are shipped by J&N Prints. Costs are charged for this shipping. These are stated at checkout.

The stated price refers exclusively to the items as literally described.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. J&N Prints cannot guarantee that the colours correspond exactly to the actual colours of the products. Obvious mistakes or errors in the offer do not bind J&N Prints. J&N Prints is only bound to a means obligation with regard to the correctness and completeness of the information provided. J&N Prints is in no case liable in the event of obvious material errors, typographical errors or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact J&N Prints in advance via info@jnprints.be or other available channels.

The offer is always valid while stocks last and can be adjusted or withdrawn by J&N Prints at any time. J&N Prints cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

Article 4: Online purchases

This is how the ordering procedure works: the Customer places items in his/her shopping cart, then the Customer clicks through to the 'checkout' where an overview of the shopping cart is shown. The Customer must then log in or register with a new customer profile. The confirmation is done via the e-mail address that the Customer provides. Then the customer chooses the shipping option and payment option. Finally, the Customer accepts the General Terms and Conditions (this document) and the sales contract is concluded.

J&N Prints is entitled to refuse an order as a result of a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and execution of the agreement

Items ordered through this webshop are delivered worldwide.

Delivery is made by PostNL and the Customer pays additional costs for this, as stated in the ordering procedure.

Unless otherwise agreed or expressly stated otherwise, the goods will be delivered to the Customer's place of residence within 30 days of receipt of the order. The delivery period is approximately 14-28 working days,

Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported immediately to J&N Prints by the Customer.

The risk of loss or damage shall pass to the Customer from the moment he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk shall pass to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by J&N Prints.

Article 6: Retention of title

The delivered items remain the exclusive property of J&N Prints until full payment has been made by the Customer.

The Customer undertakes to inform third parties of J&N Prints' retention of title if necessary, e.g. anyone who would seize items that have not yet been fully paid for.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase articles online from J&N Prints in their capacity as consumers.

The Customer has the right to cancel the agreement within a period of 14 calendar days for non-personalized and undamaged items without giving any reason.

The withdrawal period will expire 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the last shipment or the last part.";

To exercise the right of withdrawal, the Customer must inform J&N Prints, Burrelstraat 5, 9100 Sint-Niklaas, +32494172051, info@jnprints.be of his decision to withdraw from the agreement by means of an unambiguous statement (e.g. in writing by post, fax or e-mail).

To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to J&N Prints, Burrelstraat 5, 9100 Sint-Niklaas, without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to cancel the agreement to J&N Prints. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The Customer is requested to return the items in their original condition and with all accessories and instructions supplied. If the returned product has been diminished in value in any way, J&N Prints reserves the right to hold the Customer liable and claim damages for any diminished value of the goods resulting from the Customer's use of the goods that goes beyond what is necessary to establish the nature, characteristics and functioning of the goods.

All returned items are carefully examined. The starting point here is that the consumer may only inspect the item as he would be allowed to do in a store. Returned items may be tried on, but may not be used. If an item has suffered a decrease in value due to use by the Customer, this will be charged to the Customer.

If the Customer revokes the agreement, J&N Prints will refund all payments received from the Customer up to that point, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after J&N Prints has been informed of the Customer's decision to revoke the agreement. In the case of sales agreements, J&N Prints may wait with the refund until it has received all goods back, or until the Customer has demonstrated that he has returned the goods, whichever is the earliest.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by J&N Prints will not be reimbursed.

J&N Prints will reimburse the Customer using the same means of payment as the Customer used for the initial transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any fees for such reimbursement.

The Customer may not exercise the right of withdrawal for:

  • service agreements after full performance of the service;
  • personalized goods;
  • damaged goods;
  • goods purchased in sales

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to retain the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact J&N Prints and return the item to J&N Prints at his/her own expense.

Upon discovery of a defect, the Customer must inform J&N Prints as soon as possible. In any case, any defect must be reported by the Customer within 2 months of discovery. After that, any right to repair or replacement will lapse.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.

Printed textiles should always be washed cold and not tumble dried. Failure to observe this will void the guarantee.

For sublimated products, it is preferable to wash them by hand and not to put them in the dishwasher. This is to maintain the quality of the product for longer.

Defects that manifest themselves after a period of 6 months following the date of purchase or, if applicable, delivery, shall be deemed not to be hidden defects, unless the Customer provides proof to the contrary.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to J&N Prints, in the event of non-payment or late payment, the Customer shall owe, by operation of law and without notice, interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall owe, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, J&N Prints reserves the right to take back items that have not been (fully) paid for.

Article 11: Privacy

The controller, J&N Prints, respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to inspect and possibly correct your personal data. Provided proof of identity (copy of identity card) you can obtain the written notification of your personal data free of charge via a written, dated and signed request to J&N Prints, hogenakkerstraat 116, 9100 sint-niklaas, info@jnprints.be. If necessary, you can also request to correct the data that is incorrect, incomplete or not relevant.

In case of use of data for direct marketing: You can object free of charge to the use of your data for direct marketing. To this end, you can always contact J&N Prints, burrelstraat 5, 9100 sint-niklaas, info@jnprints.be

We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties.

The customer is responsible for keeping his login details confidential and using his password. Your password is stored encrypted, so J&N Prints has no access to your password.

Voel keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

Article 12: Use of cookies

During a visit to the site, 'cookies' can be placed on the hard drive of your computer. A cookie is a text file that is placed by the server of a website in the browser of your computer or on your mobile device when you consult a website. Article 13: Affectation of validity – non-waiver

If any provision of these Terms is held to be invalid, illegal or void, this will in no way affect the validity, legality and enforceability of the other provisions.

The failure at any time by J&N Prints to enforce any of the rights stated in these Terms and Conditions, or to exercise any right hereunder, shall never be deemed to be a waiver of such provision and shall never affect the validity of these rights.

Article 14: Changes to conditions

These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of J&N Prints. In the event of any conflict, these Conditions shall prevail.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.

Article 16: Applicable law – Disputes

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The courts of the Consumer's place of residence shall have jurisdiction in legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
